COMMITMENT
Maple Leaf HIFU Co. (“Maple
Leaf”)
is committed to maintaining the security, confidentiality
and privacy of your personal information. Maple Leaf respects
your privacy and strives to be an open and accessible organization.
This Privacy Policy documents our ongoing commitment to you
and has been developed in compliance with applicable privacy
legislation, including Ontario’s Personal
Health Information Protection Act, 2004.
SCOPE OF
POLICY
This Policy addresses personal information about individuals
and does not apply to the information collected, used or disclosed
with respect to corporate or commercial entities. Such information
is protected by other Maple Leaf policies and practices and through
contractual arrangements.
DEFINITIONS
In this Policy:

“collection” means
gathering, acquiring, receiving or obtaining information
from any source, by any means

“consent” means
voluntary and knowledgeable agreement to the collection,
use and disclosure of personal information for specified
purposes. In most circumstances, consent may be express
or implied

“disclosure” means
making personal information available to or releasing it
to a third party
-
“personal
information” means
information about an identifiable individual, including
information relating to the individual’s physical
or mental health, family health history, health care,
and health number. It does not include information that
cannot be associated with a specific individual
-
“third
party” means
an individual or organization other than Maple Leaf and
you
-
“use” means
the treatment and handling of personal information by and
within Maple Leaf
1. ACCOUNTABILITY
Maple Leaf is accountable and responsible for personal information
under its control. Maple Leaf has designated a Privacy Officer
who is accountable for Maple Leaf’s compliance with this
Policy.
Maple Leaf will adopt procedures to protect personal information,
receive and respond to complaints and inquiries, train staff
regarding policies and procedures and communicate policies and
procedures to you, the customer.
Maple Leaf is also responsible for personal information in its
control that has been transferred to a third party. Maple Leaf
will use contractual or other means to provide a comparable level
of protection when personal information is transferred to a third
party.
2. PERSONAL INFORMATION
Maple Leaf may collect some or all of the following information
from you, either directly or from various other sources:

your name, age, gender, marital and family status, and citizenship;

your home address, home
telephone number, cellular (mobile) phone number, email
address;

current health information and personal and family health
history information;
-
health information related to prostate cancer, including
PSA levels, cancer stage, Gleason score, and cancer treatments;
-
health information relating to health tests and test results,
including ultrasounds, MRIs, bone scans and CT scans;
-
financial and credit information about you, including credit
card numbers and bank information;
-
your provincial health number or government-issued health
number;
-
information about the treatments or services you have received
from Maple Leaf; and
-
information about your health insurance coverage and health
insurance claims.
3. PURPOSES
Maple Leaf collects your personal information for the following
reasons:

to assess your suitability for Maple Leaf’s non-invasive
prostate cancer treatment program;

to provide and administer services requested and to use
or disclose the information for any purpose related to the
provision of requested services;

to plan and deliver Maple Leaf’s programs and services,
and to evaluate and monitor those programs and services;
-
to bill accounts and maintain payment records;
-
to provide information to third-party service providers
such as clinics where procedures are performed;
-
to document and address any service issues or complaints;
-
to protect Maple Leaf, yourself and others from fraud and
error and to safeguard the financial interests of Maple Leaf;
-
to authenticate your identity;
-
to provide information
to anyone working with or for Maple Leaf as needed for
the provision of requested services; and
-
to comply with legal and regulatory requirements and to
act pursuant to legal and regulatory authorizations.
The above collections, uses and disclosures, which are not exhaustive,
are a necessary part of your relationship with Maple Leaf. By
providing such personal information to Maple Leaf, you consent
to Maple Leaf using and disclosing that information for these
purposes.
Maple Leaf may also collect
and use your personal information to inform you about Maple
Leaf’s programs, services, procedures and business which
may be of interest to you. These activities are optional, and you
may instruct Maple Leaf to refrain from using information in
these ways at any time by providing written notification to
the Privacy Officer.
When personal information that has been collected is to be used
for a purpose not previously identified, Maple Leaf will identify
the new purpose and obtain your consent before using the information
for that purpose, unless the use is authorized or required by
law.
4. CONSENT
Maple Leaf will obtain your consent to collect, use or disclose
personal information except where Maple Leaf is authorized or
required by law to do so without consent. Consent may be express
or implied, and may be provided orally, in writing, electronically,
through inaction (such as when you fail to notify Maple Leaf
that you do not wish your personal information collected/used/disclosed
for various purposes after you have received notice of those
purposes) or otherwise.
You may withdraw consent at any time, subject to legal or contractual
restrictions, provided that you give reasonable notice of your
withdrawal of consent to Maple Leaf. On receipt of notice of
withdrawal of consent, Maple Leaf will inform you of the likely
consequences of the withdrawal of consent, which may include
the inability of Maple Leaf to provide certain products or services
for which that information is necessary. Any withdrawal of consent
will not have retroactive effect.
5. LIMITS ON COLLECTION OF PERSONAL INFORMATION
Maple Leaf will not collect information indiscriminately and
will limit collection of information to that which is reasonable
and necessary to provide a product or service and which is reasonable
and necessary for the purposes consented to by you. Maple Leaf
will also collect information as authorized by law.
6. LOCATION OF PERSONAL INFORMATION
Maple Leaf is located in Ontario, Canada, and your personal
information will be collected, stored and used in Canada. Maple
Leaf will not disclose or transfer your personal information
outside of Canada without providing prior notice to you.
7. LIMITS FOR USING, DISCLOSING AND RETAINING PERSONAL INFORMATION
Your personal information will only be used or disclosed for
the purposes set out above, for purposes consented to by you
and as authorized by law.
Maple Leaf will destroy, erase or make anonymous records containing
personal information as soon as it is reasonable to assume that
the original purpose is no longer being served by retention of
the information and retention is no longer necessary for legal
or business purposes.
Maple Leaf will take due care when destroying personal information
so as to prevent unauthorized access to the information.
8. ACCURACY AND CORRECTION
Maple Leaf will make a reasonable
effort to ensure that personal information it is using or disclosing
is accurate and complete. In some cases, Maple Leaf relies
on you to ensure that certain information is current, complete,
and accurate.
If you believe that a record of your personal information is
inaccurate or incomplete, you may request in writing that Maple
Leaf correct the record. Maple Leaf will reply promptly to your
request. If Maple Leaf refuses to make the requested change,
it will give you written reasons for its decision and explain
your further options. If appropriate, Maple Leaf will send the
amended information to third parties to whom the information
has been disclosed.
9. SAFEGUARDING PERSONAL INFORMATION
Maple Leaf protects the personal information in its custody
or control by making reasonable security arrangements to prevent
unauthorized access, collection, use, disclosure, copying, modification,
disposal or similar risks.
Maple Leaf will take reasonable steps, through contractual or
other reasonable means, to ensure that a comparable level of
personal information protection is implemented by the third parties
who assist in providing services to you.
Confidentiality and security
are not assured when information is transmitted through email
or other wireless communication. Maple Leaf will not be responsible
for any loss or damage suffered as a result of a breach of
security and/or confidentiality when you transmit information
to Maple Leaf by email or other wireless communication or when
Maple Leaf transmits such information by such means at your
request.
Maple Leaf will notify you at the first reasonable opportunity
if your personal information is stolen, lost or accessed by unauthorized
persons.
10. OPENNESS
Maple Leaf is open about the policies and procedures it uses
to protect your personal information. Information about these
policies and procedures will be made available in writing and
electronically. However, to ensure the integrity of our security
procedures and business methods, Maple Leaf will not disclose
sensitive information about its policies and procedures.
Maple Leaf will make available a description of the type of
personal information held by Maple Leaf, and a general description
of its use and disclosure.
11. PROVIDING ACCESS
You have a right to access your personal information held by
Maple Leaf.
You may make a written request to Maple Leaf to access your
personal information, with sufficient detail that Maple Leaf
may identify and locate the requested information with reasonable
efforts. Upon taking reasonable steps to verify your identity,
Maple Leaf will review and respond to your request.
Maple Leaf may charge a reasonable fee for access to your personal
information.
Maple Leaf will generally make the information available within
30 days or provide written notice where additional time is required
to fulfill the request.
In some situations, Maple Leaf may not be able to provide access
to certain personal information. Where an access request is refused,
Maple Leaf will notify you in writing, document the reasons for
refusal and outline further steps which are available to you.
12. COMPLIANCE
Maple Leaf will, on request, provide information regarding its
complaint procedures.
Any inquiries, complaints or questions regarding this Policy
should be directed in writing to Maple Leaf Privacy Officer.
